Commission Meeting Procedures

Material submitted by the public for Commission review prior to a scheduled hearing should be received by the Planning Department reception counter at 1650 Mission Street, 4th floor, no later than 5:00 PM the Wednesday (eight days) prior to the scheduled public hearing. Persons unable to attend a hearing may submit written comments regarding a calendared item to: Planning Commission, 1650 Mission Street, Suite 400, San Francisco, CA 94103-2414. Comments received by 11:00 AM on the day of the hearing will be made part of the official record and will be brought to the attention of the Planning Commission at the public hearing. Otherwise, submit material related to a calendared item at the scheduled hearing for distribution. For complete distribution to all Commissioners, necessary staff and case/docket/correspondence files, submit an original plus 10 copies. When sending e-mail correspondence to Commissioners, please copy the Commission Secretary at: linda.avery@sfgov.org

Pursuant to Government Code Section 65009, if you challenge, in court, (1) the adoption or amendment of a general plan, (2) the adoption or amendment of a zoning ordinance, (3) the adoption or amendment of any regulation attached to a specific plan, (4) the adoption, amendment or modification of a development agreement, or (5) the approval of a variance, conditional-use authorization, or any permit, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission, at, or prior to, the public hearing.

Commission action on conditional-uses and reclassification may be appealed to the Board of Supervisors within 30 days. Call (415) 554-5184 for more information. Commission actions after Discretionary Review may be appealed to the Board of Appeals within 15 days of action by the Central Permit Bureau. Call (415) 575-6880 for more information. Zoning Administrator action on a variance application may be appealed to the Board of Appeals within 10 days of issuance of the written decision.

The Commission has instituted a policy that, in most cases, they will not call an item for consideration after 10:00 PM. If an item is scheduled but not called or introduced prior to 10:00 PM, the Commission may continue the matter to the next available hearing. Items listed on this calendar will not be heard before the stated time.

Cell Phone and/or Sound-Producing Electronic Devices Usage at Hearings

Effective January 21, 2001, the Board of Supervisors amended the Sunshine Ordinance by adding the following provision: The ringing of and use of cell phones, pagers and similar sound-producing electronic devices are prohibited at this meeting. Please be advised that the Chair may order the removal from the meeting room of any person(s) responsible for the ringing or use of a cell phone, pager, or other similar sound-producing electronic devices (67A.1 Prohibiting the use of cell phones, pagers and similar sound-producing electronic devices at and during public meetings).

1450 15th STREET - Lot 064 of Assessor's Block 3549, bounded by 14th Street, Folsom Street, 15th Street, and South Van Ness Avenue in the Inner Mission neighborhood. Appeal of Preliminary Mitigated Negative Declaration for demolition of the existing one-story, 20- to 26-foot-tall, approximately 8,226-square-foot (sf) industrial building, constructed in 1908, and the construction of a four-story over basement, approximately 43-foot-tall building. The proposed, approximately 32,300 gross-square-foot (gsf) building would include ten residential units on the second through fourth floors over approximately 7,100 sf of Production, Distribution, & Repair (PDR) use on the ground and basement levels. The proposed basement level would contain a ten-space residential parking garage (about 5,600 sf) with ingress and egress from Shotwell Street. The proposed project would result in an approximately 24,000 gsf increase on the project site. The approximately 8,227-sf project site is within a Light Industrial (M-1) use district and within a 50-X height and bulk district.

1450 15th Street - northwest corner of Shotwell and 15th Streets, Lot 064 in Assessor's Block 3549 - Request for Conditional Use Authorization pursuant to Planning Code Sections 215 and 303 to allow the demolition of an existing one-story industrial building and construction of a new four-story mixed-use building with 10 residential units over Production, Distribution, & Repair (PDR) uses on the ground and basement levels within an M-1 (Light Industrial) Zoning District with a 50-X Height and Bulk designation. 140 Ellis Street - between Cyril Magnin and Powell Street, Lot 023 in Assessor's Block 326 - Request for Conditional Use Authorization to convert 65 of the existing 77 residential hotel rooms into tourist hotel rooms within the six-story mixed use structure. This change of use would increase the number of tourist rooms from the existing 66 rooms to a total of 131 tourist hotel rooms with 12 residential hotel rooms still remaining within the building. The project does not propose any modifications to the building exterior or interior and consists of the change of use only. As required under the San Francisco Administrative Code, the 65 residential hotel rooms at the project site (to be converted to tourist hotel rooms) will be replaced at 317 Leavenworth Street. (A companion variance case for 317 Leavenworth (Case No. 2007.1164V) will be considered by the Zoning Administrator concurrently with this case.) The project site is located in a C-3-G (Downtown General Commercial) Zoning District and an 80-130-F Height and Bulk District.

317 Leavenworth Street - northwest corner with Eddy Street; Lot 005 in Assessor's Block 0334 - Request for Residential Open Space and Off-Street Parking Variances. The proposal is to convert the existing 65 tourist hotel room into 65 residential hotel rooms in conjunction with a reverse conversion at 140 Ellis Street. The existing building occupies the lot almost entirely, and none of the proposed residential hotel rooms would be provided with any private or common open space, nor would any off-street parking spaces be provided. The project site is located in an RC-4 (Residential-Commercial, Combined, High Density) Zoning District and an 80-T Height and Bulk District.

631 O'FARRELL STREET - south side between Hyde and Leavenworth Streets; Lot 001 through 198 in Assessor's Block 0322A - Request for Conditional Use Authorization pursuant to Section 209.6(b) of the Planning Code to legalize and operate a wireless telecommunication facility for Sprint/Nextel within the RC-4 (North of Market Residential Special Use District) and an 80-T Height and Bulk district, upon the roof of the approximately 210 foot high structure that contains 184 condominium dwelling units over ground story commercial space. As per the City and County of San Francisco's Wireless Telecommunication Services (WTS) Facilities Siting Guidelines, the proposal is a Preferred Location Preference 2, as it is the site of previously approved antenna installations. The proposal is to legalize nine antennas at three different locations upon the roof of the approximately 210-foot high building. These antennas were previously installed without benefit of a permit or Conditional Use Authorization. Related equipment would be placed within an interior storage room on the twelfth floor.

G. PUBLIC COMMENT

At this time, members of the public may address the Commission on items of interest to the public that are within the subject matter jurisdiction of the Commission except agenda items. With respect to agenda items, your opportunity to address the Commission will be afforded when the item is reached in the meeting with one exception. When the agenda item has already been reviewed in a public hearing at which members of the public were allowed to testify and the Commission has closed the public hearing, your opportunity to address the Commission must be exercised during the Public Comment portion of the Calendar. Each member of the public may address the Commission for up to three minutes.

The Brown Act forbids a commission from taking action or discussing any item not appearing on the posted agenda, including those items raised at public comment. In response to public comment, the commission is limited to:

(1) responding to statements made or questions posed by members of the public; or

(2) requesting staff to report back on a matter at a subsequent meeting; or

  • directing staff to place the item on a future agenda. (Government Code Section 54954.2(a))
