Enforcement Survey Informational Report

Recommendation: No Action Requested, Public Hearing Proposed for December 16

The Department's 1999-2000 Budget and Work Program calls for reinvigorating the Code Enforcement Program. The Work Program, as modified by the Board of Supervisors and presented to the Planning Commission in September, allocates 4.8 Full Time Equivalent positions assigned within the Neighborhood Planning division. Since each Neighborhood Planning Quadrant will have staff assigned, there is the opportunity to address specific local problems as well as respond to past and ongoing complaints.

In September the Department presented a draft Code Enforcement Work Program to the Board of Supervisors' Finance Committee, which has taken an active oversight role in the process. The Finance Committee requested that the Department implement an extensive outreach program to the neighborhood groups in shaping the program. In response to this request, staff developed a draft survey and requested extensive input on the survey format. Only then, in mid-October, was the Code Enforcement survey circulated to all organizations on the Department's Neighborhood Organization List. About sixty organizations responded in writing.

The survey showed that many organizations share the Commission's concern about adherence to conditions of approval for Commission-authorized projects. Bringing such cases to the Commission will be an important part of the Department's Code Enforcement program. Citywide, the survey indicated that other high priorities were for insuring residential demolitions go through required procedures, and preventing illegal units in new construction. Based on the survey, localized code enforcement priorities include:

SW: illegal units in new construction; non-permitted uses in residential zones

NW: non-permitted uses in residential zones

SE: nuisances from commercial uses, auto wrecking

NE: removal of rental units from housing supply; conditional use scofflaws; sign violations

Due to the Commission's busy upcoming calendars, we are proposing a public hearing for December 16, 1999 on survey findings and on proposed quadrant-specific Code Enforcement priorities. However, we did want to give you the benefit of the survey findings and a status report on the work program at this time. In the interim, until December 16, staff will be developing the quadrant-specific programs, training, forms and procedures and will continue to work on interdepartmental coordination.
