4. SECTION 106 (PAEZ)
135 VAN NESS AVENUE/170 FELL STREET, the entire city block bound by Van Ness Avenue, Fell, Franklin and Hayes Streets, Assessor’s Block 815, Lot 1. The High School of Commerce (135 Van Ness Avenue) and the Newton Tharp Commercial School (170 Fell Street) are within the boundaries of City Landmark No. 140. The site and its buildings are also designated as a contributing property within the Civic Center National Register of Historic Places and local Historic Districts. The property is within a P (Public Use) District and is in a 160-H Height and Bulk District. Request for Landmarks Preservation Advisory Board comments on an October 20, 1999 Draft Programmatic Memorandum of Agreement (PMOA). The PMOA was prepared pursuant to Section 106 of the National Historic Preservation Act to address the effect on historic properties of the Federal Emergency Management Agency (FEMA) proposal to fund the relocation of the San Francisco Unified School District administrative function from the 135 Van Ness Avenue/170 Fell Street property.

The Board supported the concept of the reuse of the property as the SOTA, and supported shifting FEMA funds to the acquisition of a new Administrative Building, so long as the replacement by SFUSD and Station Construction funds is assured.

The Board agreed to add an additional Whereas Claus to the motion - “Whereas the property owner concurs and recommends approval of the landmark designation”.
